Darrk isn’t even restrained at all, I think he’s just pretending that the penguin even noticed him and tied himself up.
Without his bat hat, he can’t be two bats, though. While I agree that he can escape by transforming into a bat, it should be a much less efficient process when he can only bat half as much as he could before. Penguincop is making a calculated risk.
